Terms of Service

InsuraCove, operated by MatchNorth, provides a free comparison and matching service that connects consumers with independent third-party providers. These Terms of Service (“Terms”) govern your access to and use of the websites, questionnaires, and related services provided by MatchNorth under the brand InsuraCove(collectively, the “Services”). By using the Services, you agree to these Terms.

THESE TERMS CONTAIN AN ARBITRATION AGREEMENT AND CLASS ACTION WAIVER. BY ACCEPTING THESE TERMS, YOU AGREE THAT DISPUTES BETWEEN YOU AND INSURACOVE WILL BE RESOLVED BY BINDING, INDIVIDUAL ARBITRATION, AND YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

What the Services are (and are not)

InsuraCoveis an independent comparison and matching service. We are not a law firm, insurance carrier, insurance agent, lender, broker, or healthcare provider, and we do not provide legal, financial, insurance, tax, or medical advice. When you submit a request, we share it with one or more independent third-party providers (“Providers”) matched to your answers, and those Providers — not InsuraCove — deliver any professional services. Any engagement, quote, policy, retainer, or other relationship you enter into is solely between you and the Provider. InsuraCoveacts as a passive conduit and makes no guarantee about the accuracy, quality, availability, or outcome of any Provider’s services.

Eligibility and use of the Services

You must be at least 18 years old and located in the United States to submit a matching request. You agree to provide accurate, current information about yourself and to use the Services only for their intended purpose and not for any illicit, unlawful, or abusive activity.

Changes to the Terms of Service

We may modify these Terms from time to time. Changes become effective when posted on this page. Your continued use of the Services after changes become effective constitutes your acceptance of the new Terms. MatchNorth, through InsuraCove, assists users by ensuring transparency in how such changes are communicated.

Recording Consent and Mobile Devices

ALL TELEPHONE COMMUNICATIONS WITH INSURACOVE MAY BE RECORDED AT INSURACOVE’S SOLE DISCRETION, AND YOU HEREBY CONSENT TO SUCH RECORDING.

To the extent you access the Services through a mobile device, your wireless service carrier’s standard charges, data rates, and other fees may apply. By using the Services from a mobile device, you agree that we may communicate with you regarding InsuraCove and other entities by SMS, MMS, text message, or other electronic means to your mobile device and that certain information about your usage of the Services may be communicated to us. In the event you change or deactivate your mobile telephone number, you agree to promptly notify us to ensure that your messages are not sent to the person that acquires your old number.

Consent

BY SUBMITTING YOUR CONTACT INFORMATION TO INSURACOVE, YOU ARE REQUESTING TO BE (AND YOU EXPRESSLY CONSENT TO BE) CONTACTED BY INSURACOVE, MATCHNORTH, ITS PARTNERS, AND THE PROVIDERS THAT RECEIVE YOUR REQUEST, THROUGH ANY OF THE CONTACT MEANS (PHONE, TEXT MESSAGE, EMAIL, OR MAIL) YOU HAVE PROVIDED. YOU ALSO EXPRESSLY CONSENT TO BE CONTACTED BY SOME OR ALL OF THESE BUSINESSES BY PHONE, E-MAIL, TEXT, OR SMS MESSAGING AT THE NUMBER OR EMAIL ADDRESS YOU HAVE PROVIDED, INCLUDING CALLS OR TEXT MESSAGES MADE USING AN AUTOMATED TELEPHONE DIALING SYSTEM OR USING AN ARTIFICIAL OR PRERECORDED MESSAGE, REGARDLESS OF WHETHER THE NUMBER(S) PROVIDED ARE ON A CORPORATE, STATE, OR NATIONAL DO NOT CALL LIST OR REGISTRY. YOU ALSO EXPRESSLY CONSENT TO THE RECORDING OF ALL PHONE CALLS BETWEEN YOU AND INSURACOVE OR THE PROVIDERS THAT RECEIVE YOUR REQUEST. YOUR PROVISION OF SUCH CONSENT IS NOT A CONDITION OF ANY PURCHASE OR SERVICES.

Analyzing Your Communications

We may review, scan, or analyze your communications on the InsuraCove platform, including text messages and phone calls between you and InsuraCove, for fraud prevention, risk assessment, regulatory compliance, investigation, product development, research, and customer support purposes. We use automated methods where reasonably possible. However, occasionally we may need to manually review some communications, such as for fraud investigations and customer support, or to assess and improve the functionality of these automated tools. We will not review, scan, or analyze your communications to send third-party marketing messages to you, and we will not sell reviews or analyses of these communications.

Prohibited conduct

You agree not to engage in any of the following prohibited activities:

• Submitting false, misleading, or another person’s information
• Harvesting, scraping, or collecting content or information from the Services (see our Data Usage Policy)
• Interfering with, or attempting to interfere with, the proper working of the Services, including by circumventing any security or verification measure (such as SMS PIN verification)
• Using the Services for any unlawful purpose or in violation of any applicable law
• Transmitting viruses, malware, or any code of a destructive or disruptive nature

Suspension or Termination

InsuraCove may terminate or suspend your ability to use the Services, in whole or in part, at our sole discretion, for any or no reason, and without notice or liability of any kind. For example, we may terminate or suspend your ability to use the Services if you misuse them. MatchNorth reserves this right to ensure the integrity of InsuraCove’s Services.

Ownership

The Services and all materials therein — including software, design, text, graphics, and logos — are the property of MatchNorth or its licensors and are protected by intellectual-property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial use. No other rights are granted.

Warranties; Limitation of Liability

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. INSURACOVE MAKES NO WARRANTY ABOUT ANY PROVIDER OR THE SERVICES, PRICING, OR OUTCOMES ANY PROVIDER DELIVERS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL MATCHNORTH OR INSURACOVEBE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES OR ANY PROVIDER’S SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES IS LIMITED TO ONE HUNDRED U.S. DOLLARS ($100).

Indemnification

You agree to defend, indemnify, and hold harmless MatchNorth, InsuraCove, and their officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your use of the Services, your violation of these Terms, or your violation of any rights of another.

Dispute Resolution By Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the Services that cannot be resolved informally shall be resolved by binding, individual arbitration administered by a recognized arbitration provider under its consumer arbitration rules, rather than in court, except that either party may bring an individual claim in small-claims court. The arbitration will be conducted on an individual basis only; class arbitrations and class actions are not permitted. You may opt out of this arbitration agreement by emailing us within 30 days of first accepting these Terms.

Miscellaneous

These Terms constitute the entire agreement between you and MatchNorth regarding the Services. If any provision of these Terms is held invalid, the remaining provisions remain in full force. Our failure to enforce any right or provision is not a waiver. You may not assign these Terms; we may assign them without restriction. These Terms are governed by the laws of the United States and the state in which MatchNorth is organized, without regard to conflict-of-law principles.
